This Privacy Policy explains how IA Distribution Ltd., doing business as Inner Armour Sports Nutrition (“Inner Armour,” “we,” “us” or “our”), collects, uses, discloses and otherwise handles personal information through our Shopify-powered online store, related websites, customer service, marketing and Canadian sales activities (collectively, the “Store”). IA Distribution Ltd. is the legal owner and operator of the Store.

This Canadian policy applies when you access or use the Store from Canada or place an order for delivery in Canada. If another regional policy is presented to you, that policy may also apply to the services or transaction identified in it.

1. Accountability and scope

We are responsible for personal information under our control. Our Privacy Officer oversees our privacy program and can be contacted using the details at the end of this Policy.

“Personal information” means information about an identifiable individual, subject to exclusions under applicable law. This Policy does not apply to anonymous or de-identified information that cannot reasonably be linked to you.

2. Information we collect

Depending on how you interact with the Store, we may collect:

  • Identity and contact information, such as your name, email address, telephone number, billing address and shipping address.
  • Account information, such as login credentials, saved preferences, loyalty or subscription details and account activity.
  • Order and transaction information, such as products viewed or purchased, order value, discounts, currency, payment status, returns, refunds and delivery details.
  • Payment-related information. Payment card and other payment credentials are generally processed by Shopify Payments or another enabled payment provider. We may receive limited payment, verification and transaction details rather than complete card information.
  • Customer-service and communication information, including inquiries, reviews, survey responses, warranty or return requests and records of our communications.
  • Business and wholesale information, such as company name, role, tax or resale information and purchasing history, if you interact with us in a business capacity.
  • Device and network information, such as IP address, browser, device identifiers, operating system, language, time zone and general location derived from IP address.
  • Store usage information, such as pages and products viewed, searches, clicks, referring pages, cart activity and interactions with emails or advertisements.
  • Marketing and preference information, including your communication choices, consent records and inferred product interests.
  • Information from service providers and partners, including Shopify, Store applications, payment providers, fraud-prevention providers, advertising partners, analytics providers, carriers and social-media platforms, where permitted by law.

3. How we collect information

We collect information directly from you when you create an account, place an order, contact us, subscribe to marketing, enter a promotion, submit a review or otherwise provide it. We also collect information automatically through Shopify and technologies such as cookies, pixels, software development kits and similar tools. We may receive information from service providers, affiliates and partners involved in operating the Store or serving you.

4. Why we use personal information

We may use personal information to:

  • Provide, operate and maintain the Store.
  • Display products, availability, pricing, currency, shipping options and content appropriate to your selected or approximate Canadian location.
  • Create and manage accounts, carts, orders, payments, returns, refunds, subscriptions and deliveries.
  • Communicate with you about orders, service messages, inquiries and support.
  • Personalize the Store and recommend relevant products or content where permitted.
  • Send email, text or other marketing communications with the consent required by law and honour unsubscribe requests.
  • Measure Store performance, understand customer use and improve our products, services and marketing.
  • Detect, investigate and prevent fraud, abuse, security incidents and violations of our terms.
  • Maintain business, tax, accounting, product-safety, warranty and legal records.
  • Comply with law, enforce agreements and establish, exercise or defend legal claims.
  • Support a corporate transaction, such as a financing, merger, reorganization or sale, subject to applicable safeguards.

5. Location-based products, availability and pricing

The Store may use your selected market, delivery address, device settings and approximate location derived from your IP address to determine which products, inventory, prices, currency, taxes, promotions, shipping methods or content to display. This regionalization is generally automated, but it is not intended to make a decision that has a legal or similarly significant effect on you. You may be able to change your country or region using the Store’s market selector. Final price, availability, taxes and shipping charges are confirmed at checkout.

6. Consent and other permitted uses

We obtain consent where required and may rely on express or implied consent depending on the sensitivity of the information and the reasonable expectations associated with the transaction. For example, when you provide a delivery address, we may use and disclose it to fulfill your order. We seek express consent for marketing or non-essential cookies where required.

You may withdraw consent, subject to legal or contractual restrictions and reasonable notice. Withdrawal will not affect processing already completed lawfully and may limit our ability to provide a requested product or service. We may also collect, use or disclose information without consent where Canadian law permits or requires it.

7. Shopify and Store technologies

Shopify hosts the Store and processes information needed to provide storefront, account, checkout, payment, security, analytics and related commerce services. Shopify may process information in countries other than Canada and may act as our service provider or, for certain Shopify consumer services, for its own purposes.

If you use Shop, Shop Pay or another Shopify consumer service, Shopify’s own terms and privacy notices also apply. Where Shopify Network Intelligence or related enhanced services are enabled, Shopify may use information from your interactions with this Store and other Shopify merchants to provide services such as fraud prevention, personalization, analytics and advertising, subject to applicable privacy choices.

8. Cookies, analytics and advertising

We and our providers may use strictly necessary cookies to operate checkout, accounts, security and Store functions. With consent where required, we may also use functional, analytics and advertising cookies or similar technologies to remember preferences, measure performance, personalize content and evaluate or deliver advertising.

Our cookie banner or “Privacy choices” link describes available controls. Browser settings can also block or delete cookies, but some Store features may not work correctly. Where an opt-out preference signal is legally recognized and supported by our systems, we will process it as required.

9. When we disclose information

We may disclose personal information to:

  • Shopify and enabled Store applications that host, secure, analyze or support the Store.
  • Payment processors, banks and fraud-prevention providers.
  • Warehouses, distributors, carriers, customs brokers and delivery partners.
  • Marketing, advertising, analytics, communications and customer-support providers, subject to consent or opt-out rights where required.
  • Our affiliates, including IA Distribution USA Ltd., when needed for cross-border sales, distribution, support or administration.
  • Accountants, auditors, insurers, lawyers and other professional advisers.
  • Government, regulatory, law-enforcement or other parties where required or permitted by law.
  • A buyer, investor or successor in connection with a proposed or completed business transaction, subject to appropriate confidentiality and legal requirements.

We do not sell personal information for money. Some advertising or analytics disclosures may be treated as a “sale,” “sharing” or targeted advertising under laws outside Canada; the policy and privacy controls for the relevant region will apply.

10. Processing outside your province or Canada

We, Shopify and other providers may process personal information in Canada, the United States and other countries. Information processed elsewhere may be subject to the laws of that jurisdiction and accessible to courts, law enforcement or national-security authorities as permitted by law. We use contractual, organizational and technical measures appropriate to the nature of the information and the service provider relationship.

11. Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, including to provide services, maintain business and transaction records, meet tax, accounting, product-safety and legal obligations, resolve disputes and enforce agreements. Retention periods vary according to the type of record, sensitivity, legal requirements and whether an account or business relationship remains active. We then delete or de-identify information where reasonably practicable.

12. Safeguards

We use administrative, technical and physical safeguards appropriate to the sensitivity and amount of information, the purposes for which it is used and the format in which it is stored. No method of transmission or storage is completely secure. You are responsible for safeguarding your account credentials and should contact us if you believe your account or information has been compromised.

13. Your Canadian privacy rights

Subject to applicable law and limited exceptions, you may request access to personal information we hold about you, information about its use and disclosure, and correction of inaccurate or incomplete information. You may also withdraw consent or ask questions or make a complaint about our practices.

Quebec residents may have additional rights, including rights relating to automated processing, data portability and the cessation of dissemination or de-indexing in circumstances provided by law. Our Privacy Officer performs the functions assigned to the person in charge of the protection of personal information.

We may need to verify your identity before completing a request. If we cannot fulfill a request, we will explain the reason where required. You may also contact the Office of the Privacy Commissioner of Canada or the privacy regulator in your province.

14. Marketing communications

You may unsubscribe from promotional emails using the link in the message or by contacting us. We may still send non-promotional messages needed to service your account or transaction, such as order, recall, security or policy notices. Consent to electronic marketing is managed in accordance with applicable Canadian anti-spam requirements.

15. Children

The Store is intended for a general adult audience and is not directed to children under 13. We do not knowingly collect personal information from children under 13. A parent or guardian who believes a child has provided information should contact us. Where a higher age threshold or parental-consent standard applies, we will follow local law.

16. Changes to this Policy

We may update this Policy to reflect changes to the Store, Shopify features, our practices or legal requirements. We will post the revised version and update the “last updated” date. We will provide additional notice or seek consent if required by law.
